These Terms of Service (“Terms”) are a legal agreement between you and ZebraHouse Studios Inc. (“ZebraHouse Studios,” “we,” “us,” or “our”) governing your use of the games we publish (each a “Game,” and together our “Games”), including Floppy Fish. By downloading, installing, or playing any of our Games, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use our Games.
You must be at least 13 years old (or the age of majority in your jurisdiction) to use our Games. If you are under the age of majority, you may use our Games only with the consent of a parent or legal guardian, who agrees to be bound by these Terms.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use our Games for your personal, non-commercial entertainment on Apple devices you own or control, as permitted by the App Store’s rules.
You agree not to: (a) copy, modify, or create derivative works of our Games; (b) reverse engineer, decompile, or disassemble our Games except as permitted by law; (c) rent, lease, sell, or sublicense our Games; (d) cheat, use bots, exploit bugs, or manipulate scores or leaderboards; (e) use our Games unlawfully or in violation of these Terms; or (f) interfere with or disrupt our Games or their servers.
Our Games offer leaderboards via Apple Game Center. We may remove scores, reset rankings, or restrict access if we reasonably believe scores were obtained through cheating, manipulation, or a violation of these Terms. Leaderboard functionality is provided “as is” and may change or be discontinued.
Our Games offer premium in-app currency and other paid items — for example, Coins and Pearls in Floppy Fish, where Pearls are the premium currency. Purchases are made through the App Store and processed by Apple under Apple’s terms. By purchasing, you acknowledge:
If you are signed in to iCloud, your Pearls balance, unlocked skins, starter-pack status, and high scores may be stored in your iCloud account so they persist across reinstalls and devices. This feature depends on Apple’s iCloud and on your being signed in; we are not responsible for iCloud availability, syncing delays, or data loss. Cloud-stored game data has no monetary value and remains subject to this Section.
Our Games are supported by advertising, including interstitial ads and optional rewarded ads you choose to view. Ads are provided by third parties (e.g., Google AdMob) and are subject to their terms and our Privacy Policy. We are not responsible for the content of third-party ads.
Our Games, including their software, artwork, characters, design, and trademarks, are owned by ZebraHouse Studios or its licensors and are protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.
OUR GAMES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR GAMES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEBRAHOUSE STUDIOS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF OUR GAMES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US THROUGH THE RELEVANT GAME IN THE 12 MONTHS BEFORE THE CLAIM OR CAD $50.
You agree to indemnify and hold harmless ZebraHouse Studios from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of our Games or violation of these Terms.
These Terms remain in effect until terminated. We may suspend or terminate your access at any time if you violate these Terms. You may stop using our Games at any time. Provisions that by their nature should survive (e.g., IP, disclaimers, liability limits, virtual-currency forfeiture) survive termination.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The courts of British Columbia will have jurisdiction, subject to any mandatory consumer-protection rights you have where you live.
We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date and, where appropriate, by in-app notice. Continued use after changes take effect constitutes acceptance.
These Terms are between you and ZebraHouse Studios only, not with Apple. Apple is not responsible for our Games or their content. Apple has no obligation to provide maintenance or support for our Games. If a Game fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to our Games, including product liability, legal/regulatory compliance, or consumer-protection claims. In the event of any third-party claim that a Game infringes intellectual property rights, ZebraHouse Studios, not Apple, is responsible. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
